1. This promotion (Promotion) is being run by Carter Holt Harvey LVL (CHH LVL) trading as Futurebuild®.
2. The Promotion is open from Tuesday 30th October 2018 and will close at 5pm on Thursday 1 November (the Promotional Period). No entries will be accepted outside the Promotional Period.
3. To become a participant (Participant) in the Promotion you must be a member of the Futurebuild LVL Database (Database) and provide all required information (full name, phone number, email address, company, and mailing address) (Registration) during the Promotional Period.
4. Registration and entry into the Promotion may occur via any of the following modes:
a. through a sign-up form available at www.thetreeproject.co.nz
b. via an email sent to the current CHH LVL Database
5. During Registration you may opt to receive a pine seedling (Seedling) based on availability and on the terms outlined below.
6. CHH LVL intends to have 150 Seedlings available to give away as part of the Promotion. The Seedlings will be allocated to the first 150 Participants to complete Registration (Top 150). Any entries beyond the Top 150 will not automatically receive a Seedling.
7. As the Seedling is a living tree, CHH LVL may, at its discretion reduce the number of available Seedlings at any time if fewer Seedlings are available for reasons outside of CHH LVL’s control.
8. The Seedlings will be allocated to the Top 150 at the CHH LVL Head Office; Captain Springs Road, Onehunga, Auckland, on Thursday 1st November 2018.
9. The Seedling will be posted (at CHH LVL’s expense) to the Top 150 at the address nominated by the Participant when completing registration to the Database. If no appropriate mailing address has been provided, CHH LVL will use reasonable efforts to contact that Participant to obtain a suitable mailing address. If the Participant is unwilling to provide the necessary details or is unable to be contacted then that Participant will be deemed to have forfeited their allocated Seedling. The forfeited Seedling will then be allocated to the next Participant in order of Registration.
10. In the event that the Participant in the Top 150 notifies CHH LVL that the Participant does not wish to receive the Seedling, CHH LVL will then allocate that Seedling to the next Participant in order of Registration.
11. If the Participant is under the age of 18, the Participant must obtain permission from the Participant’s parent or legal guardian before entering the Promotion. If the Participant is under age of 18, the Seedling will be awarded to the Participant’s parent or legal guardian.
12. The Seedling is not deferrable, transferable (except where required pursuant to clause 11), exchangeable or redeemable for cash or other products.
13. CHH LVL does not accept any responsibility for any sign up that is lost or received outside the Promotional Period.
14. Participants must supply all the details requested during the Registration process and comply with all rules to be eligible for the Top 150 and allocated a Seedling.
15. The Promotion is open to New Zealand residents only.
16. Seedlings are not available to employees or immediate family members of CHH LVL, nor any person directly or indirectly involved in the Carter Holt Harvey, any of its related entities and/or persons involved in the running of the Promotion.
17. CHH LVL takes no responsibility for ineligible or fraudulently-made Registrations.
18. CHH LVL’s decision is final in every situation and no correspondence will be engaged in.
19. CHH LVL reserves the right to cancel the Promotion at any stage.
20. By Registering and entering the Promotion, the Participant is deemed to have accepted these terms and conditions and agrees to be bound by the same.
21. To the extent permitted by law, CHH LVL, its employees and agents will not be liable for any claims, damages, injuries, costs and expenses suffered, sustained or incurred as a result of, or arising out of, or in any way connected with the Promotion and/or the Seedling.
22. CHH LVL is not responsible or liable for any problems or technical malfunction of computer on-line systems, servers or providers, traffic congestion of the internet or at the website or any combination of technical problems which may result in delay in completing Registration and entering into the Promotion.
A. By completing Registration, the Participant will be providing CHH LVL with personal information that CHH LVL may use to communicate with the Participant regarding the Promotion and to keep the Participant informed about new products, services and other information that may be of interest to the Participant. Under the Privacy Act 1993, the Participant is entitled to access the personal information that CHH LVL holds about that Participant and correct it if there are errors, inconsistencies or the information requires updating. CHH LVL complies with its obligations under privacy legislation when dealing with personal information.

C. By providing an email address the Participant consents to CHH LVL communicating with them via this email address. If the Participant does not wish to be emailed the Participant may unsubscribe at the footer of any email, or by contacting the CHH LVL Privacy Officer by email at privacyofficer@chh.co.nz or phone +64 9 636 7016.
